Recent Victories – Speeding Cases in Duluth Municipal Court
During the week of November 12-16, our office handled 3 different speeding cases in Duluth Municipal Court. Here is a breakdown of the tickets and the results that we were able to achieve for our clients:
Here Are A Few Successful Cases We Litigated In Duluth GA
- The first client was issued a speeding ticket for operating a motor vehicle at sixty-two (62) miles per hour in a forty-five (45) mile per hour zone. The client was facing two (2) points on his driving record for this offense. We were able to negotiate a resolution with the city prosecutor whereby the speeding ticket was amended to a non-reporting violation called “Too Fast for Conditions” and no points were assessed against our client’s driving record and nothing was reported to the Georgia Department of Driver Services. Thanks to some proper preparation ahead of time, we made the necessary appearance before Judge Charles Barrett in Duluth Municipal Court, and our client did not need to appear in court.
- The second client was charged with speeding ticket at sixty-four (64) miles per hour in a forty-five (45) mile per hour zone. This was a three (3) point offense. Also, even though it was the client’s third offense for speeding in the last five years, we were able to negotiate a great resolution with the city prosecutor - the ticket was amended to a non-reporting violation and no points were assessed against our client’s driving record and nothing was reported to the Georgia Department of Driver Services. Again, we handled the case without our client making any appearances to court. We did that preparing a “plea in absentia” document and sending it to our client to be signed and notarized. The client returned the document, along with a money order (made out the court) to us prior to the hearing date. That allowed us to handle the case in front of Judge Barrett.
- The third client was issued a speeding ticket for driving their car at sixty-three (63) miles per hour in a forty-five (45) mile per hour zone. That carries two (2) points against the driving record. Even though it was the client’s fourth offense in the last five years, we worked out a fantastic deal with the city prosecutor and the client’s ticket was reduced and amended to a non-reporting violation and no points were assessed against our client’s driving record and nothing was reported to the Georgia Department of Driver Services. He was certainly very happy. However, in this case, since the client had a bit of a checkered driving history, we did ask the client to take a one time in person defensive driving class, which helped in our negotiation efforts with the prosecutor. As we always try to do to save our clients time and add value to the case, we made the necessary appearance before Judge Charles Barrett in Duluth Municipal Court without our client having to take time off of work and personally appear.
