Open Container Violation

Georgia Code 40-6-253 outlines the law regarding consumption of alcoholic beverages or possession of open containers of alcoholic beverage in the passenger area of an automobile.  It should not come as a surprise that you cannot have an open container of alcohol in the car.  If for example, you are a passenger in a vehicle and you are drinking a can of beer, you are in violation of the open container law. So basically the person with the open container is the one committing the offense.

What if you are driving your car with no passengers and there is an open bottle of whiskey in the back seat that your friend forgot to take home with him after you all attended a party the night before?  In that instance, you can be charged with violating the open container law. What if you went out to dinner and ordered a bottle of wine, but could not finish it and now want to take it home with you in your car?  Well, if the previously opened bottle is then sealed, you can take it with you in the car, as this is an exception to the Georgia open container law.  In general, however, it is really important to make sure you never have open containers of alcohol in your vehicle.
